Dhaka, Bangladesh Global: The Appellate Division of the Supreme Court on Thursday ordered for reinstatement of jobs to the 1,137 deprived candidates in the 27th Bangladesh Civil Service (BCS) nearly 17 years ago.
A full bench of the Appellate Division, led by Chief Justice Syed Refaat Ahmed, issued this order after hearing on three separate review petitions.
Petitioners' lawyers Md Salahuddin Dolon said as per the High Court ruling the appointments should be made within 90 days. So, those 90 days have been upheld.
Senior lawyer Salah Uddin Dolon, Md Ruhul Kuddus and Mohammad Shishir Monir represented the appellants while additional attorney general Anik R Haque represented the state, and Mohammad Khalekuzzaman Bhuiyan represented the Public Service Commission (PSC) in the court.
More than a hundred candidates were present in the courtroom during the verdict.
During the 1/11 caretaker government, the decision was made to cancel the first viva exam in the 27th BCS, and a second round of viva was conducted.
However, those deprived of recruitment submitted a writ challenging the second viva.
In 2008, a High Court (HC) bench declared the cancellation of the first viva result as valid. However, in 2009, another HC bench declared the second viva to be illegal.
Subsequently, 140 individuals filed separate petitions on behalf of the 1,137 affected candidates, seeking a review of the decision.
Furthermore, the government submitted three leave-to-appeal petitions against the second verdict.
After some observations, the Appellate Division resolved the government's leave-to-appeal petitions and delivered its verdict in 2010.
The Appellate Division upheld the HC’s ruling, validating the decision to cancel the first viva examination.
Following a review petition against the Appellate Division's verdict, the leave to appeal was granted. Three separate appeals were filed on behalf of 1,137 candidates deprived of recruitment last year.
After hearing the appeals, the Appellate Division delivered the verdict today.
